Mediation Services

Mediation is a voluntary, confidential process where parties work with a neutral third party to resolve disputes. Unlike judges or arbitrators, mediators do not issue decisions. Instead, they guide discussions to help parties reach mutually acceptable agreements. The foundation of mediation is built on two key principles: party control and confidentiality.

Party Control
In mediation, participants maintain full authority over the outcome. The mediator facilitates communication and problem-solving but does not determine the result, allowing the parties to shape their own resolution.

Confidentiality
Mediation provides a private setting for open and honest dialogue. Parties may share information with the mediator in confidence, knowing it will not be disclosed or used in court. This confidentiality encourages constructive communication and supports effective negotiation.

While often viewed as a last resort before trial, mediation can be beneficial at any stage of a dispute.

Types of Mediation

Case Management Mediation
Engaging a mediator early in litigation offers a proactive approach to managing the case. The mediator can assist with planning discovery, resolving early disagreements, or coordinating litigation schedules. This helps parties avoid unnecessary delays and maintain greater control throughout the process.

Interim or Discovery Mediation
When conflicts arise during litigation, especially around discovery or information sharing, mediation can provide a faster and more cost-effective resolution. It keeps cases on track and prevents interim disputes from overwhelming the court.

Settlement Mediation
Often conducted after discovery or information exchange, settlement mediation focuses on final resolution. With a clearer understanding of the case, parties are better positioned to negotiate a comprehensive settlement and avoid the uncertainty and cost of trial.

No matter the timing, mediation offers a flexible, efficient, and confidential path to resolution. It empowers parties to make informed decisions and move forward.
